Discrimination-Free Workplace 2011

As the year winds down, employers are busy with Open Enrollments, Budgets and Planning. Don’t forget to make harassment training an important action item for your organization.

Claims filed with EEOC hit an all-time high for their Fiscal Year 2009, which ended in September 2010. The increase in claims was across the board – with over 93,000 claims filed:

Retaliation - All Statutes 33,613*
Race 33,579
Retaliation - Title VII only 28,948
Sex 28,028
Age 22,778
Disability 21,451
National Origin 11,134
Religion 3,386

*For the first time, there were more Retaliatory than Racial Discrimination claims filed.

The Agency has heard testimony regarding the impact of discrimination on older workers and Age Discrimination charges rose over 3% in the last year. Their upcoming lawsuits show a wide range of charges pending with Disability Discrimination and Retaliation tied for the highest number of filings.

The Equal Employment Opportunity Commission is increasing their hours, staff and backlog resolution as part of their new commitment to service. As claims increased in 2010, they worked hard to keep pace: backlog increased less than 1%. As they work harder to resolve claims, is your company working harder to avoid EEOC filings? No charges have been filed under GINA or the ADA Amendments Act YET, however the EEO has been granted statutory authority over these areas and claims will certainly be forthcoming. Under the ADA alone, the following increases were seen:

  • Disability Discrimination filings– increased over 10%
  • Monetary benefits awarded – increased nearly 10%
  • Reasonable cause success rate – increased nearly 13%
  • Withdrawals with benefits – increased over 15%
